1. About These Terms
These Terms of Service govern the use of the Effective Web website and, where incorporated into an accepted proposal or agreement, the provision of our digital services.
Effective Web is operated by:

By using our website, you agree to the website-related provisions of these Terms.
The purchase of professional services is subject to a separately accepted proposal, statement of work or service agreement. Where a signed agreement conflicts with these general Terms, the signed agreement takes precedence unless it expressly provides otherwise.
2. Our Services

Website design and development.
WordPress and Elementor implementation.
Ecommerce and product catalogue solutions.
Branding and digital identity.
Landing pages and conversion-focused websites.
Search engine optimisation and search-readiness improvements.

The specific deliverables, responsibilities, timetable and price for each project will be defined in the relevant proposal or agreement.
3. Pricing and Quotations
Prices displayed on our website are indicative unless expressly stated otherwise.
Our currently advertised packages include:
Starter: AED 4,500, plus AED 367 per month for Managed Website Care, subject to a 12-month minimum commitment.
Professional: From AED 16,000.
Distributor: From AED 20,000.
The scope, pricing and ongoing support for Professional and Distributor projects are confirmed individually.
Additional functionality, integrations, content creation, extra pages, licences and other services may incur additional charges.
Any applicable taxes, third-party costs and payment terms will be specified in the proposal or invoice.
We reserve the right to revise publicly displayed prices for future projects. Accepted contractual pricing will be governed by the applicable agreement.
4. Project Commencement and Payments
Work begins following acceptance of the agreed scope and satisfaction of any required initial payment or onboarding conditions.
For Starter projects, the proposed standard payment arrangement is:
50% upon project commencement.
50% before website launch or final handover.
Larger projects may use milestone-based payment arrangements stated in the proposal.
Invoices are payable according to the agreed terms.
We may suspend work for materially overdue payments after providing appropriate notice, subject to applicable law and contractual requirements.
5. Client Responsibilities
Clients are responsible for:
Providing accurate business and project information.
Supplying required content, branding and access credentials.
Confirming that supplied materials may lawfully be used.
Reviewing designs and deliverables within agreed timeframes.
Providing timely feedback and approvals.
Obtaining required approvals for their business activities, products, marketing claims and website content.
Maintaining appropriate rights to their domain names, trademarks and third-party materials.
Delays in receiving necessary information or approvals may affect delivery schedules.
6. Project Scope and Revisions
Each project is delivered according to the scope agreed in writing.
The Starter package includes one consolidated revision round unless otherwise specified.
Professional and Distributor revision arrangements are defined in the accepted proposal.
Requests outside the agreed scope may require a revised quotation, additional fees or timeline adjustments.
We will seek approval before undertaking chargeable out-of-scope work.
7. Delivery Timelines
Estimated delivery periods depend on project complexity, content readiness, integrations, approvals and other dependencies.
Indicative planning ranges may include:
Starter: approximately 1–2 weeks after required content and approvals are received.
Professional: approximately 4–8 weeks.
Distributor or complex projects: approximately 6–12 weeks or longer.
These are estimates, not guaranteed completion dates, unless an agreement expressly establishes a binding deadline.
8. Hosting and Managed Website Care
Where included in an agreed package, Managed Website Care may cover:
Managed website hosting.
SSL certificate administration.
Website backups.
WordPress and Elementor updates.
Security and compatibility monitoring.
Uptime monitoring.
Up to 30 minutes of minor content changes per month for the Starter care plan.
The Starter care plan is subject to a 12-month minimum commitment.
Unused monthly content-change time does not accumulate unless expressly agreed.
Major redesigns, new features, substantial content changes, premium third-party subscriptions and integrations are outside routine maintenance unless included in the relevant agreement.
Renewal, cancellation notice periods, billing arrangements, migration assistance and any early termination charges must be specified in the accepted service agreement.
9. Third-Party Products and Services
Projects may use WordPress, Elementor, WooCommerce, hosting providers, payment gateways, analytics tools, plugins, APIs and other third-party services.
Third-party products are subject to their respective licences, terms, availability and technical limitations.
Unless expressly included in the proposal, external subscription, licence, transaction and usage fees are the client’s responsibility.
We cannot guarantee the uninterrupted operation or continued availability of services outside our reasonable control.
10. Intellectual Property
Clients retain ownership of materials they provide, subject to any third-party rights.
Upon receipt of all amounts due, the client receives the rights to final, specifically commissioned deliverables as described in the applicable agreement.
Pre-existing tools, reusable frameworks, development methods, licensed assets, software components and third-party products remain subject to their respective ownership and licensing arrangements.
Ownership of domain names, hosting accounts, source files and third-party licences should be expressly defined in the project agreement.
Effective Web may display completed work in its portfolio only where permitted by the relevant agreement or separately authorised by the client.
11. Search Engines, AI Discovery and Performance
We may design websites using recognised technical, usability, search optimisation and structured-content practices.
However, we do not guarantee:
Specific Google or Bing rankings.
Inclusion in search engine or AI-generated recommendations.
Particular traffic, enquiry, conversion or revenue results.
Continuous indexing by search engines.
Specific outcomes from advertising campaigns.
Results depend on many factors beyond our control, including market competition, search engine algorithms, customer demand and third-party platforms.
12. Testing, Acceptance and Launch
We will carry out testing appropriate to the agreed project scope.
Clients are responsible for reviewing the delivered website and identifying material issues within the agreed acceptance period.
Launch arrangements, approval procedures and any post-launch correction period will be defined in the relevant agreement.
Defects attributable to our work will be addressed according to the agreed warranty or support terms. New requirements or changes outside scope may be separately chargeable.
13. Confidentiality and Data Protection
Each party agrees to handle confidential business information responsibly and in accordance with applicable agreements.
Where Effective Web processes personal information on behalf of a client, the parties may need a separate data-processing agreement defining their respective obligations.
Clients remain responsible for their own website privacy notices, cookie practices, lawful data collection and regulatory compliance unless specific compliance services are expressly included in the scope.
14. Cancellations and Termination
Project cancellation, refunds, treatment of completed work, non-refundable third-party commitments and early termination of recurring services will be governed by the accepted proposal or service agreement and applicable law.
We will not impose undisclosed cancellation charges.
Either party may have termination rights for material breach, subject to the notice and remedy provisions in the applicable agreement.
15. Warranties and Liability
We will perform our services with reasonable professional care and skill.
Except for obligations that cannot lawfully be excluded, we do not guarantee that websites or third-party services will be completely error-free or continuously available.
Any contractual limitations of liability must be reasonable, lawful and expressly defined in the relevant agreement.
Nothing in these Terms excludes liability that cannot legally be excluded or restricts mandatory statutory rights.
Legal review required: The final agreement should establish an appropriate liability cap, exclusions and treatment of indirect losses.
16. Acceptable Website Use
Visitors must not misuse our website, attempt unauthorised access, introduce malicious code, interfere with its operation or use it for unlawful purposes.
Website content, branding and materials may not be reproduced commercially without permission, except as allowed by applicable law.
17. Governing Law and Disputes
[GOVERNING LAW AND COMPETENT COURTS — TO BE CONFIRMED AFTER LEGAL ENTITY REGISTRATION]
Mandatory consumer, privacy or other legal protections applicable in relevant jurisdictions remain unaffected where they cannot lawfully be excluded.
18. Changes to These Terms
We may update these website Terms periodically.
Changes to an existing signed client agreement will be made only in accordance with that agreement and applicable law.
